Her arraignment Thursday morning on the new charge replaced the original murder charge.

Under state law, committing murder when the victim is younger than 14 can elevate the crime to aggravated murder. If convicted, Buckley could face the death penalty.

In Oregon, a jury decides whether a defendant convicted of aggravated murder should receive a death sentence.

Buckley appeared Thursday morning in a neon yellow-green, Washington County Jail jumpsuit, and mostly looked down as she waited to be arraigned before Circuit Court Judge Kirsten E. Thompson . Her defense attorneys, Greg Scholl and Chris Colburn, entered the not-guilty plea on her behalf.

Buckley was arrested last week, after being released from medical care, according to the Sherwood Police Department. She is being held in the Washington County Jail, without bail.

Shortly before 5 p.m. on June 2, police and fire crews responded to the 17600 block of Southwest Galewood Drive after receiving a report that a child was injured. Inside the home, police found Buckley's husband, Patrick, performing CPR on Cecilia, and they also tried to help resuscitate the unresponsive girl, court records say. She was transported to a local hospital, where she was pronounced dead.

An autopsy completed June 3 determined that the girl's cause of death was homicide, consistent with strangulation.

Kristina Buckley told police she strangled her daughter with her hands until she believed the girl was dead in part because she wanted to "save and protect" her from pedophiles, according to court records. Her husband told investigators that his wife had a "psychotic episode," during which she demonstrated “paranoid and delusional behavior,” days before the girl was killed, court records say.

Patrick Buckley, according to court records, took his wife to a psychiatrist, who prescribed "anti-psychotic medication.”

Kristina Buckley, court records say, told officers she also tried to kill herself, but couldn't. She was transported to a local hospital, where police say she remained until last week.

Her next court appearance is scheduled for Monday.

This whole thing is maddening. Not sure what the right thing to do is, but I'm pretty sure giving this woman mental health care as opposed to prison time would be the best course of action. No chance of that, of course, but one can dream. I don't see her as a danger to anyone provided she gets the mental health treatment she needs, but instead of paying for some medication and treatment, we get to pay for a lifetime of incarceration, medication, treatment, and all of the spendy hubbub involved with a death penalty trial.

Summary: A suspected drunken driver, whose vehicle rolled into a Washington County Sheriff's vehicle during a traffic stop, has been convicted and sentenced in Washington County Circuit Court.

The case: On March 25, a Washington County Sheriff's deputy attempted to pull over a speeding driver suspected of DUII. The driver continued driving for four miles until he reached the entrance of Stub Stewart State Park, according to authorities. When David Brewer, 51, stopped and stepped out of the truck, the vehicle began to roll backwards towards the deputy's car. Brewer could not stop the vehicle before it rolled into the front of the patrol car, causing $2,000 damage. No one was injured. Brewer was arrested on multiple accusations.

Update: On May 20, Brewer pleaded guilty to DUII and attempt to elude. The other two charges he was facing were dismissed. While on release awaiting his court appearance, Brewer committed another DUII offense on April 8, according to Matt Hall, deputy district attorney for Washington County.

Sentence: Brewer was sentenced to two years' probation, was fined $1,934 and ordered to pay $2,810.65 in restitution plus various legal fees for the March 25 chase. He received six months in jail and was fined $2,000 for the April 8 incident. Brewer may not possess or consume alcohol and must undergo evaluation, treatment and counseling for drug and alcohol abuse. He also cannot enter bars, taverns or liquor stores, Hall said.
